1. General settings
1.1. The owner of the Online Store www.ehituseabc.ee (hereinafter Ehituse ABC Online Store) is Optimera Estonia AS (registry code 11269030), located at Peterburi road 71, 11415 Tallinn.
2. Validity of sales contract, product and price information
2.1. The conditions of sales are valid when purchasing goods via Ehituse ABC Online Store.
2.2. The prices sold through Ehituse ABC Online Store have been specified for the products. All prices include value added tax of 20%. A delivery fee will be added to the price.
2.3. The delivery fee depends on the location of the purchaser and the method of delivery. The delivery fee will be displayed to the purchaser upon placing the order.
2.4. Product details have been given with the respective product at Ehituse ABC Online Store. The product information is regularly checked and updated. As the product details have been entered by the producers, Ehituse ABC Online Store assumes no liability for the correctness of the details.
2.5. Product photos are illustrative.
3. Order placement
3.1. To order goods you must add products to the cart. To place an order, you must fill in the required fields and choose a suitable delivery method. Then the fee will be displayed, which can be paid either through a bank link or with another payment method.
3.2. The contract shall enter into force as of the receipt of the amount due to the current account of Optimera Estonia AS.
3.3. If the ordered goods cannot be delivered because their supply has run out or due to another reason, the purchaser will be informed thereof as soon as possible and the money paid (including the delivery fee) will be returned promptly, but not later than 14 days as of the receipt of the notice.
3.4. The orders made via the Online Store are processed on working days (Mo–Fri) from 9–17.00. This also applies for the delivery method “I will pick up the goods myself”.
4.1. The goods are delivered only in the territory of Estonia.
4.2. The delivery fee is paid by the purchaser and the respective price list is displayed with the delivery methods.
4.3. Deliveries usually reach the destination specified by the purchaser within 5 working days as of entry into force of the sales agreement.
4.4. The purchaser will be informed by phone or via e-mail when the goods are ready to be collected.
5.Right of withdrawal
5.1. After receiving the order the purchaser has the right to withdraw from the contract entered into at the Online Store within 14 days.
5.2. The right of withdrawal does not apply if the purchaser is a legal person.
5.3. To use the 14-day right of withdrawal, the ordered goods cannot be used in any other way than necessary to verify the nature, properties and functioning of the goods as is permitted for testing the goods at a real store. The returned product must be complete, i.e. include all parts included in the product package. If the product has been purchased during a campaign and another product has been added thereto, the whole set of products must be returned.
5.4. If the goods have been used for other purposes than necessary for verifying the nature, properties and functioning of the goods or there are signs of use or wear, Ehituse ABC Online Store shall have the right to reduce the returned fee according to the decreased value of the goods.
5.5. To return goods, an application for withdrawal must be submitted, information on which can be found here.
5.6. The purchaser shall incur the costs of returning the goods, except when the goods are returned because they do not comply with the order (e.g. wrong or defective product).
5.7. The returned goods must be unused and in the original package. The packaging of the goods must be in good condition and clean. The commercial appearance of the product must be fully preserved.
5.8. The purchaser must return the goods within 14 days as of submitting the application or submit evidence that they have transferred the goods to the carrier within the said period.
5.9. Ehituse ABC Online Store will immediately return all payments received from the purchaser under the contract upon receiving the returned goods, but not later than within 14 days as of receipt of the application for withdrawal.
5.10. The Online Store may refuse to make the repayment until it has received the returned product or the purchaser has submitted evidence that they have sent the product back, depending on which takes place earlier.
5.11. If the purchaser has explicitly chosen a delivery method that is not the cheapest from the selection of regular delivery methods on Ehituse ABC Online Store, the Online Store does not have to return to the purchaser the cost exceeding that of the regular delivery method.
5.12. Ehituse ABC Online Store reserves the right to withdraw from the sales transaction and demand the goods back from the purchaser if the price of the goods on the website has been specified as significantly lower than the market price thereof.
6. Right to submit claims
6.1. Ehituse ABC Online Store shall be liable for the lack of conformity of the sold goods with the terms and conditions of the Contract which existed at the time of their transfer and which become evident within two years as of the transfer of goods to the purchaser. Within six months as of the transfer of the goods to the purchaser it is presumed that the deficiency already existed at the time of transfer of the goods. Refuting such presumption is the liability of Ehituse ABC Online Store.
6.2. Ehituse ABC Online Store is not liable for the depreciation/damage of the product due to the purchaser, any deficiencies caused to the product due to improper usage thereof nor normal wear and tear of the product during its normal usage.
6.3. In the event of a deficiency, the purchaser has the right to contact Optimera Estonia AS within two years by sending an e-mail to email@example.com or calling +372 55638871.
6.4. Optimera Estonia AS is not liable for the deficiencies that have arisen after the transfer thereof to the purchaser.
6.5. If a product purchased from Ehituse ABC online store has deficiencies for which the Online Store is liable, the Online Store shall repair or replace the said product. If the product cannot be repaired or replaced, the Online Store shall repay to the purchaser all costs arisen with the sales contract.
6.6. The Online Store shall reply to a claim submitted by a consumer in writing or in a format that can be reproduced in writing within 15 days.
7. Direct marketing and processing of personal data
7.1. The Online Store uses the personal data provided by the purchaser (incl. name, telephone number, address, e-mail address, bank details) only for processing the order and sending the goods to the purchaser.
7.2. The Online Store shall forward the persona data to companies providing delivery services for them to deliver the goods.
7.3. The Online Store shall send the purchaser newsletters and offers to the purchaser’s e-mail address only if the purchaser has made such a request by entering their e-mail address on the website and declared their wish to receive direct mails.
7.4. The purchaser has the right to withdraw from offers or newsletters sent to the e-mail address by informing us thereof via e-mail or by following the instructions in the e-mail containing the offer.
8. Settlement of Disputes
8.1. If the purchaser has complaints about the Online Store, they send these to the e-mail address firstname.lastname@example.org.
8.2. If the purchaser and the Online Store fail to resolve the dispute by way of negotiations, the purchaser has the right to turn to the Consumer Disputes Committee. The procedural conditions can be viewed here and the application can be submitted here. The Consumer Disputes Committee has the capacity to resolve disputes arising from the contract entered between the purchaser and the Online store. Reviewing the purchaser’s complaint by the committee is free of charge. The purchaser may turn to the platform solving consumer disputes in the European Union
8.3. Optimera Estonia AS shall be liable to the customer and the customer shall be liable to Optimera Estonia AS for any damage caused to the other party due to a breach of these terms and conditions in the instances and to the extent stipulated in the current legislation of the Republic of Estonia.
8.4. Optimera Estonia AS shall not be liable for the damages caused to the customer or delay of product if the damage or delay has been caused by circumstances which Optimera Estonia AS could not have influenced and could not reasonably have been expected (force majeure).
